1. About these terms

These terms apply to your use of welcomefinance.co.uk and app.welcomefinance.co.uk (together, the website) and to the broking services we provide. Please read them carefully. By using the website or asking us to look for finance, you agree to these terms.

In these terms, we, us and our mean:

You and your mean the business that uses our services, and the person using the website on its behalf.

2. What we do

Welcome Finance is a commercial finance broker. We are not a lender. We help eligible businesses find finance by introducing them to lenders and funders on our panel. We do not lend money, and we do not decide whether finance is offered.

We work with a panel of lenders and funders. We do not search the whole market. Our Disclosure page explains how we work and how we are paid.

3. Who our services are for

Our services are only for businesses. We arrange unregulated commercial finance for all UK businesses including:

•        UK limited companies

•        limited liability partnerships (LLPs)

•        partnerships with four or more partners

Each lender on our panel sets its own minimum trading period. We do not arrange finance for individuals or partnerships of fewer than four partners, and we do not arrange mortgages or property finance.

By using our services, you confirm that you are acting for a business that meets these criteria, and that you have authority to act for it.

4. No guarantee of finance

We cannot promise that we will find finance for your business, or that any lender will make an offer. Every lending decision, and the terms of any offer, is made by the lender alone, based on its own criteria and checks.

Any finance agreement will be between your business and the lender. The lender’s own terms will apply to it. Please read them carefully before you sign.

5. Information you give us

You agree to:

•        give us information that is true, complete and up to date

•        tell us promptly if anything changes

•        only give us information about other people, such as directors or guarantors, if you are allowed to and they know it will be shared

We pass your information to lenders and rely on it being accurate. Giving false or misleading information to obtain finance may be a criminal offence, and we may report it to fraud prevention agencies.

6. Fees and commission

We are usually paid a commission by the lender when your finance completes.

7. Calculators, guides and other website content

Our calculators, eligibility checker, finance finder, guides and articles are for general information only. Calculator results are estimates based on the figures you enter. They are not quotes or offers, and actual rates, costs and terms will be set by the lender.

Nothing on the website is financial, legal, tax or accounting advice. You should take independent professional advice before making financial decisions.

We try to keep the website accurate and up to date, but we do not guarantee that it is complete, accurate or free from errors.

8. Using the website

You must not:

•        use the website for anything unlawful or fraudulent

•        try to gain unauthorised access to the website, our systems or any data

•        introduce viruses or other harmful code

•        copy, scrape or harvest content or data from the website by automated means

We may suspend or change the website, or any part of it, at any time without notice.

9. Intellectual property

We own, or are licensed to use, all content on the website, including text, graphics, logos, calculators and software. "Welcome Finance" is a UK registered trade mark. You may view and print pages for your own business use, but you must not copy, reproduce or use our content for any other purpose without our written permission.

10. Links to other websites

The website may link to other websites, including lender websites. We do not control those websites and are not responsible for their content, products or privacy practices.

11. Our liability

To support free usage of our Service, we must expressly exclude liability for any inaccuracies, service failures or errors to the fullest extent permitted by law. Accordingly, we cannot provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information offered through the Service.
To the extent permitted by applicable law, each party shall only be liable to the other party for any loss or damage which results as a directly foreseeable consequence of its breach of this Agreement or negligence (except in the case of fraud or wilful misconduct).
Nothing in these terms shall seek to exclude or limit liability for death or personal injury or any other liability that cannot be lawfully excluded or limited.

14. Changes to these terms

We may update these terms from time to time. The version on the website when you use it, or when you ask us to look for finance, will apply.

15. General

If any part of these terms is found to be unenforceable, the rest will remain in force. If we do not enforce a right straight away, we can still enforce it later. Only you and we have rights under these terms.

16. Law and jurisdiction

These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
